The United States Environmental Protection Agency (“EPA”) entered into an Expedited Settlement Agreement (“ESA”) with Hutchinson Oil Co., LLC (“Hutchinson”) to address an alleged violation of the underground storage tank (“UST”) regulations.
EPA settlement through the use of an ESA generally involves a more streamlined process for eligible lesser violations.
The ESA states that Hutchinson is an owner or operator of a UST at Hutch’s #117 in Liberal, Kansas. The alleged UST violation is described as:
No. 0.2 gph Line Tests for Diesel between JUN14 and SEP14 – Failure to provide adequate release detection method
The UST regulatory citation is 40 C.F.R. 280.40(a) [K.A.R. 28-44-23(a)].
The assessed penalty is $420.
