The United States Environmental Protection Agency (“EPA”) and Circle K Stores, Inc. (“Circle K”) entered into an Expedited Settlement Agreement (“ESA”) resolving alleged violations of the federal/State of Washington regulations addressing underground storage tanks (“USTs”). See Docket No. RCRA 10-2017-0016.
The ESA states that Circle K is the owner/operator of a facility denominated Circle K #6029 utilizing USTs in Kennewick, Washington.
The Circle K USTs are alleged to have failed to comply with certain requirements of Subtitle I of the Resource Conservation and Recovery Act, 42 U.S.C. §§ 6991-6991m and Chapter 173-360 of the Washington Administrative Code. The alleged violations include:
Failure to provide corrosion protection to metal piping as required by WAC 173-360-305 (2)(b) referencing Line #1, Line #2, and Line #3 from August 29, 2016 to present
Circle K neither admits nor denies the ESA’s factual allegations.
The ESA assesses a civil penalty of $2,550.
