The Louisiana State Legislature (“Legislature”) conveyed on March 14th for the 2016 Regular Session.
The organization Louisiana Environmental Action Network (“LEAN”) recently identified a number of bills which either directly or indirectly involve environmental and/or natural resource issues.
Examples include:
- House Bill (“HB”) 371 is described as prohibiting:
- … the governing authority of any public school or school in a special school district from approving, authorizing or implementing the plan for the construction of a new school for grades pre-K through 12 on land formerly used in commercial disposal, the commercial storage or the commercial disposition of sewage sludge, solid waste, hazardous waste or oilfield waste.
- HB 469 would require that:
- … certain facilities to implement a fenced-line air monitoring system. On or before July 1, 2017, the owner or operator of each facility must install and continuously operate a fenced-line air monitoring system at both the property boundary and the facility closest to the nearest residential community and the downwind property boundary of the facility.
- HB 192 prohibits local ordinances regulating certain containers and bags.
- HB 526 requires permits for certain groundwater users.
- HB 527 prohibits certain uses of surface water from a scenic river.
- HB 632 addresses financial security required by applicants for drilling permits.
- HB 819 provides for the Oil Field Site Restoration Fund.
- HB 823 provides for heightened drinking water quality water standards and increased enforcement of water system safety regulations in certain parishes.
- Senate Bill (“SB”) provides for landowner notification when an operator transfers an oil or gas well
- SB 257 addresses underground storage tanks and the Motor Fuels Underground Storage Tank Trust Fund
