The Alabama Department of Environmental Management (“ADEM”) and the City of Arab, Alabama (“City”)entered into a Special Order by Consent (“Order”) addressing certain alleged violations.
The Order addresses the alleged receipt of materials by the landfill it was not permitted to accept.
The Order states that the City operates a construction/demolition landfill (“landfill”) in Marshall County, Alabama.
ADEM issued the landfill a renewal Solid Waste Disposal Permit for its operation on September 2, 2015. State agency personnel are stated to have inspected the landfill on October 29, 2015 and identified the following violations:
- The Permittee failed to operate and use the landfill unit as stipulated in the permit.Waste accepted at the facility shall be strictly controlled so as to allow only waste stipulated on the permit or otherwise approved by the Department.Department staff observed that the Permittee had accepted for disposal putrescible waste containing free liquids (i.e. wine).The facility is not approved to receive this waste stream.
The Order provides that the City neither admits nor denies ADEM’s contentions.
The Order assesses a civil penalty to the City of $4,000.00.
