The Arkansas Department of Environmental Quality (“ADEQ”) and Shumaker Public Service Corporation (“SPSC”) entered into a November 13th Permit Appeal Resolution (“PAR”). See Docket No. 15-003-P.
SPSC owns and operates a wastewater treatment system near East Camden, Arkansas.
The company had filed a June 10th Request for Commission Review and Adjudicatory Hearing (“Request”) in regards to an ADEQ final permitting decision on its Clean Water Act National Pollution Discharge Elimination System (“NPDES”) permit renewal. The term “Commission” refers to the Arkansas Pollution Control and Ecology Commission.
SPSC in its Request challenged certain conditions in the renewed NPDES permit such as:
- Compliance Schedule for Sub-lethal Whole Effluent Toxicity Limit
- Request for Reduction in Monitoring Frequency
- Financial Assurance Requirement
- Requirement to Finalize Copper Water Effect Ratio
The November 13th PAR provides specific language revisions to the renewed NPDES permit to which the parties have agreed.
