The Iowa Attorney General on behalf of the Iowa Department of Natural Resources filed a Petition in Equity (“Petition”) in Iowa District Court against Feinberg Recycling LLC (“Feinberg”) and Marty Feinberg alleging violations of various Iowa environmental laws.
Feinberg is a Fort Madison, Iowa recycling facility.
The Petition alleges violations of Iowa air quality, water quality and solid waste laws. The violations allegedly involve:
- Open burning
- Failure to obtain an air quality construction permit
- Failure to comply with emission standards and other requirements for hazardous air pollutants for a secondary aluminum production
- Failure to comply with the facility’s stormwater discharge permit
- Failure to comply with waste tire storage limits
