The United States Environmental Protection Agency has published in today’s Federal Register:
- The Clean Power Plan Final Rule
- Proposed Federal Plan
- Carbon Pollution Standards for New, Modified and Reconstructed Power Plants
See 80 Fed. Reg. 64662.
In a related development, 24 states (including Arkansas) have filed a Petition for Review stating in part:
Pursuant to Section 307(d)(1) of the Clean Air Act 42 U.S.C. § 7607(b)(1), Section 702 of the Administrative Procedures Act, 5 U.S.C. § 702, and Rule 15(a) of the Federal Rules of Appellate Procedure, … hereby petition for review of the final action of the Respondent United States Environmental Protection Agency published in the Federal Register 80 Fed. Reg. 64661 (Oct. 23, 2015) entitled “Carbon Pollution Emission Guidelines for Existing Stationary Sources: Electric Utility Generating Units.”
