Stuart Spencer and Lorielle Gutting of the Arkansas Department of Environmental Quality (“ADEQ”) undertook a presentation for my University of Little Rock School of Law Environmental Law class titled “Environmental Overview from a State Regulator”.
Stuart is Associate Director of the Office of Air Quality and Lorielle Gutting is Managing Attorney at ADEQ.
The purpose of their presentation was to familiarize the students with both the baseline federal environmental and Arkansas specific environmental regulatory programs. Their discussion included topics such as:
- ADEQ authority
- Role of the States in environmental protection
- Arkansas as a co-regulator (with the Environmental Protection Agency [“EPA”])
- Inspection, enforcement and environmental data collection activities
- State funding for implementation of the delegated federal programs
- Federal/State delegation issues
- Examples of delegated federal baseline programs operated by ADEQ
- Clean Water Act
- Resource Conservation and Recovery Act
Stuart and Lorielle also provided both an introduction and update on the Clean Air Act Clean Power Plan from an Arkansas perspective. The discussion addressed the choices States must now make in view of United States Supreme Court’s recent stay of EPA’s implementation of the Clean Power Plan.
