The United States Environmental Protection Agency and the State of Mississippi (“EPA”) and the City of Greenville, Mississippi (“Greenville”) have entered into a Partial Consent Decree (“Consent Decree”) to address alleged Clean Water Act violations.
EPA had previously filed a lawsuit under the Clean Water Act and the Mississippi Air and Water Pollution Control law in the United States District Court for the Northern District of Mississippi seeking injunctive relief and civil penalties for alleged violations in connection with Greenville’s sanitary’s sewage system.
Greenville is stated to have grouped various systems within its sewer system into three different groups and prioritized Sewer Group 1 and Sewer Group 2 for sewer assessment and rehabilitation work. The Consent Decree provides for Greenville to:
- Conduct early action projects
- Capacity management
- Operations
- Maintenance programs
- Assessment and rehabilitation of Sewer Groups 1 and 2
The Consent Decree is characterized as a partial settlement which will not resolve the claims for civil penalties or for injunctive relief related to Sewer Group 3. Sewer Group 3 is stated to be scheduled as a topic for future negotiation among the parties.
