The United States Environmental Protection Agency (“EPA”) announced in a January 28th news release that it has redesignated Crittenden County, Arkansas as attaining the federal 2008 ozone National Ambien Air Quality Standard (“NAAQS”).
Crittenden County is part of the tri-state greater Memphis area air quality control region (“AQCR”) that had been nonattainment for the NAAQS.
NAAQS are ambient standards established by EPA for designated criteria air pollutants. AQCRs failing to attain a particular criteria air pollutant NAAQS are designated to be nonattainment.
Such nonattainment status may require states to adopt additional regulatory programs designed to achieve the NAAQS.
