The Tennessee Department of Environment and Conservation (“TDEC”) and Oakcrest Lumber, Inc. (“Oakcrest”) entered into a January 6th Technical Secretary’s Order and Assessment of Civil Penalty (“Order”) addressing alleged air violations.
The Order states that Oakcrest operates a facility in Newport, Tennessee.
The facility is stated to utilize a 400 horse power wood-fired boiler pursuant to an Operating Permit.
The facility’s Construction Permit limited visible emissions at the facility to “not greater than twenty percent (20%) opacity except for (1) 6-minute period in any one (1) hour period.” The permit further specifies that visible emissions must be determined using EPA method 9 (6-minute average).
TDEC conducted a Visible Emissions Evaluation at the facility on April 17, 2015. The Visible Emissions Evaluation is alleged to have indicated three 6-minute periods of greater than 20% opacity.
A Notice of Violation was issued to Oakcrest for the alleged violation.
The Order assesses a civil penalty to Oakcrest of $500.
